1. Acceptance of Terms
By installing or using Host ("the App"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.
2. Description of Service
Host is a Shopify application that provides AI-powered popup widgets designed to capture leads, collect zero-party data, and improve conversions on your Shopify store.
3. Account & Installation
- You must have a valid Shopify store to use Host.
- You are responsible for maintaining the security of your Shopify account.
- One installation is permitted per Shopify store.
4. Free Trial & Billing
- Free Trial: New users receive a 14-day free trial with full access to all features.
- Billing: After the trial, charges are billed through Shopify's billing system according to your selected plan.
- Cancellation: You may cancel at any time through the Shopify app management page. Cancellation takes effect at the end of the current billing period.
- Refunds: Refunds are handled per Shopify's refund policies.
5. Acceptable Use
You agree NOT to use Host to:
- Display deceptive, misleading, or fraudulent content
- Collect data in violation of privacy laws (GDPR, CCPA, etc.)
- Send spam or unsolicited communications
- Impersonate other brands or individuals
- Violate Shopify's Acceptable Use Policy
Violation of these terms may result in immediate suspension or termination of your access.
6. Your Responsibilities
- Ensure your popup content complies with applicable laws
- Obtain necessary consents for data collection in your jurisdiction
- Maintain accurate discount codes and offers displayed in popups
- Properly configure CRM integrations
7. Intellectual Property
- Host and its technology are owned by Host Inc. You receive a license to use the App, not ownership.
- Your store content, branding, and customer data remain your property.
- You grant us a limited license to display your branding within popups and to analyze anonymized usage patterns.
8. AI & Machine Learning
Host uses artificial intelligence to:
- Analyze your website to extract brand colors and styling
- Generate popup copy and designs
- Optimize popup timing and targeting
AI learning is performed on aggregated, anonymized data. We do not train AI on individual customer personal information.
9. Disclaimer of Warranties
Host is provided "as is" without warranties of any kind. We do not guarantee:
- Specific conversion rates or revenue increases
- 100% uptime or uninterrupted service
- Compatibility with all Shopify themes or apps
10. Limitation of Liability
To the maximum extent permitted by law, Host Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App. Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Host Inc. from any claims, damages, or expenses arising from your use of the App or violation of these terms.
12. Changes to Terms
We may modify these terms at any time. Continued use of the App after changes constitutes acceptance of the new terms.
13. Termination
Either party may terminate this agreement at any time. Upon termination:
- Your access to Host will be revoked
- Popups will stop appearing on your store
- Your data will be deleted per our Privacy Policy
14. Governing Law
These terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.
